WORK REFUSALS

Question: Is being uncomfortable grounds for a work refusal?

Answer: Generally, no. A refusal to work is justified only if there is or the worker reasonably believes there is a risk of serious injury or death. Mere discomfort isn’t enough. However, these cases aren’t set in stone and discomfort can be grounds if, for example, a worker has a special kind of physical condition such as a serious allergy to a uniform’s material.
