Manufacturer Convicted in Scissor Lift Incident & Fined $110,000

A worker for a manufacturer of vehicle exhaust systems was operating a scissor lift to perform maintenance on a ventilation system when the lift tipped over. He suffered a broken arm and head injuries. An MOL investigation found that a tire on the lift drove into an opening in a coolant collection trough, causing the machine to tip over. A court convicted the manufacturer at trial, finding that it failed to ensure that the worksite floor was free from the obstruction or hazard of an uncovered opening and that a grate for the trough was secured in place.
