Supreme Court Rejects Suncor’s Random Drug Test Policy Appeal

The latest round in the long running battle over Suncor Energy’s random drug testing policy for safety-sensitive workers at oilsands sites went to the union with the Supreme Court of Canada declined to hear the company’s appeal. As per usual practice, the Court provided no reasons for its decision which effectively leaves intact the Alberta Court of Queen’s Bench’s stunning Dec. 7, 2017 decision barring Suncor from enforcing the policy to spare workers from the irreparable privacy damage it would inflict. The case is now back in arbitration [Unifor Local 707A v. Suncor Energy Inc., 2018 CanLII 53457 (SCC), June 14, 2018].
