Should workers’ comp cover the medical marijuana an injured nurse needed to relieve the chronic pain from her work-related injuries’ Yes, said the WCB and the Appeals Tribunal agreed. (Sec. 187 of) the workers’ comp law gives workers the benefit of the doubt on compensation issues, the Tribunal explained, and the nurse easily met the ‘as likely as not’ standard proving her need for medical cannabis, including doctor testimony that it alleviated her pain and helped her appetite. The fact that she used the stuff recreationally before she got injured was no bar to medical coverage now [2016-457-AD (Re), 2018 CanLII 2394 (NS WCAT), Jan. 22, 2018].
