Injuries Caused by Seizure in the Workplace Covered by Workers’ Comp

While in the workplace and on duty, a truck driver had a seizure, fell to the concrete floor and suffered a right shoulder fracture, rotator cuff tear, fractured nose and facial lacerations. His workers’ comp claim was denied because the WCB concluded that the seizure that resulted in his injuries wasn’t caused by work conditions. On appeal, the Commission concluded that working excessive hours resulted in sleep deprivation and fatigue, which contributed to the driver’s collapse. And because an employment hazard contributed to his collapse, his condition and the resulting injuries were compensable [Decision No.: 2013-0327, [2013] CanLII 41033 (AB WCAC), June 26, 2013].
