OHS laws require you to offer immediate care for work injuries but don’t require you to force workers to accept it. But even though workers have the legal right to decline treatment, you can still get into a heap of trouble if you don’t handle the situation right. Specifically, you must ensure that the worker has the capacity and information necessary to make a legally valid refusal decision.
