Plant Sues Truck Company for Power Outage Caused by Its Driver

A garbage truck backed into a power pole causing a power outage at a nearby plant. The owner of the plant sued the driver’s employer for damages, including business losses allegedly suffered while the power was out. But the court said no dice. Negligence victims can get damages for resulting property damage they suffer but not for purely economic losses. There are 5 exceptions to the rule, the court explained, but none of them applied. And because the owner couldn’t even prove it suffered property damage as a result of the accident, all it walked away from the case with was an order to pay the $25 the employer shelled out to file his response to the complaint [Bond Reproductions Inc. v. Revolution Resource Recovery Inc., 2018 BCPC 241 (CanLII), Oct. 9, 2019].
