Fall at Home Is Work-Related When It Aggravates Previous Work Injuries

A worker who suffers an injury in a fall while she’s off-duty and in her own home normally doesn’t qualify for workers comp. But this case was different because the shoulder injuries the worker sustained significantly aggravated injuries she suffered that were work-related. The medical evidence showed that the new injuries would probably have been far less severe if not for those work injuries, the Nova Scotia Workers Comp Appeals Tribunal reasoned in awarding the worker benefits [2019-430-AD (Re), 2021 CanLII 83386 (NS WCAT), August 30, 2021].
