Exposure to Dust & Substances Caused Worker’s Asthma

A worker’s claim for coverage of occupational asthma was denied. On appeal, the Commission found that the worker was exposed to occupational risks while he worked at a fertilizer plant, including exposure to peat dust, perlite, fertilizers, gases and solvents. Although these substances were within the OELs, they still posed a risk to the worker and lead to the development of symptoms consistent with asthma. And there was no evidence he had pre-existing respiratory problems. Thus, the Commission concluded that the worker had a compensable claim for occupational asthma [Decision No: 2013-0103, [2013] CanLII 11106 (AB WCAC), March 6, 2013].
