Home Forums Community Are you required to have a joint health and safety committee or a health and safety representative if you have a company of 25 employees that meet at a shop briefly in the morning to get work orders and equipment and then leave in their crew to the work site? The work sites have prime contractors and they company is on site for less than 90 days.

    Under Sec. 16(1)(a) of the Alberta OHS Act, a workplace health and safety committee is required if there are 20 or more workers at the site but only where work is expected to last 90 days or more. Consequently:

    * No committee is required at site where crew members go to work after getting their instructions.
    * On paper, a committee would be required at the permanent shop where workers are meeting to get their marching orders because there are >20 workers and the site is presumably in existence for over 90 days. The odd thing is that the workers aren’t doing any actual work at that site. In that situation, I think you’d have to apply to the Director for a variance or exemption under Sec. 16(4). Unfortunately, Alberta guidelines don’t address this situation. I’d suggest you call the agency directly and ask whether exemption is necessary. Contact info:
