Worker’s Conditions Not Caused by Overexposure to Carbon Dioxide

A worker claimed that she developed chronic fatigue syndrome and multiple chemical sensitivities syndrome due to exposure to high levels of carbon dioxide in the workplace. Her workers’ comp claim was denied. The Appeals Tribunal said that although the carbon dioxide levels in her office were above ASHRAE recommended levels in one air quality test, they met the guidelines on another. In addition, there was insufficient evidence that exposure to elevated levels of CO₂ caused her symptoms [2012-327-AD (Re), [2013] CanLII 2383 (NS WCAT), Jan. 22, 2013].
