A company and union had various issues about the JHSC and management of the OHS program. An arbitrator ruled that it was appropriate for department superintendants to approve the agendas set by the JHSC for quarterly department safety meetings as doing so was consistent with their managerial and health and safety duties. However, the new incident investigation process instituted by management violated the collective agreement and the OHS program [Communications, Energy and Paperworkers’ Union, Local 1119 v.
