CASE OF THE YEAR
Potato Farmers Fined $3,150 Each for Environmental Violations
Two potato farmers were charged with violating the Environmental Protection Act by cultivating a row crop on land that had a slope greater than 9%. The court convicted the farmers, ruling that they’d cultivated potatoes on 4.15 hectares of land with a slope that was too steep. Although they were renting the field and no one saw them personally cultivating the land, the court was satisfied that the evidence tied them to the field’s crop. It fined them each $3,150 [Alex Docherty and Blake MacDonald, The Guardian, Sept. 27, 2013].
