BENEFITS

The OHS laws bar employers from disciplining workers for exercising their safety rights, such as by refusing unsafe work or contacting the government about unsafe work conditions. And the Canadian Criminal Code makes it illegal to fire, discipline, suspend, penalize, intimidate or coerce a worker for ‘whistleblowing,’ which includes reporting an OHS violation to the Ministry of Labour. So disciplining a worker in retaliation for blowing the whistle on the company or exercising their safety rights can expose the company to liability.

HOW TO USE THIS TOOL

Adapt this Model Non-Retaliation Policy to be consistent with your company’s OHS program and the OHS laws in your jurisdiction and train all company employees’including senior management, supervisors and workers’on it.
