Dec. 20: All Psychological Injuries Now Covered by Rebuttable Presumption


Bill 39, an amendment to The Workers’ Compensation Act, 2013, took effect on Dec. 20, 2016. A presumption for work-related PTSD was previously established; Bill 39 extends that presumption to all forms of psychological injury caused by workplace trauma. That is, if a worker has experienced a traumatic event or a number of events in the course of work and has been diagnosed as having a psychological injury, it’s now presumed that the injury is the result of his employment.
