Most OHS fines are handed down by a court or administrative tribunal after a company is found or pleads guilty to a violation. But in recent years, 5 jurisdictions have changed their laws to allow OHS inspectors to hand out fines on the spot for certain kinds of violations. While smaller than court penalties (Alberta’s are the highest at up to $10,000), these tack-on fines, aka, administrative monetary penalties (AMPs) don’t require a court proceeding (although they may be subject to appeal) and don’t ban the prosecution from charging you for the same offence.
