Nov. 15: Union Wants Increased Use of Criminal Negligence Charges
Representatives from the United Steelworkers asked for improved enforcement of the so-called Westray or C-45 amendments to the Criminal Code that allow for employers to be held criminally negligent for certain safety incidents. The union’s campaign, www.stopthekilling.ca, asks justice ministers and attorneys-general to ensure:
- Crown attorneys are educated, trained and directed to apply the amendments
- Dedicated prosecutors are given responsibility for health and safety fatalities
- Police are educated, trained and directed to apply these amendments
- OHS regulators are trained to reach out to police when criminal negligence charges may be warranted.
