A judge decided that criminal charges against Vadim Kazenelson, Project Manager for Metron Construction, should go to trial. The charges are based on the Christmas Eve incident from 2009 in which four workers on a suspended scaffold fell 14 stories to their deaths. Last year, Metron pleaded guilty to criminal negligence and was fined $200,000. Metron’s owner, Joel Swartz, also pleaded guilty to four OHS violations and was fined $90,000.
