Can a Statement Made to Alberta OHS Officers Be Used as Evidence?


For several years the following question has been asked: “Can a statement given to OHS Officers investigating a workplace accident be used as evidence in a criminal prosecution in Alberta?” In other words, can your own words, which are compelled by provincial law on pain of jail for refusing, be used as evidence against you in a criminal prosecution?
