Group Failed to Prove Wind Farm Would Cause Harm

The government issued an approval for the construction of a wind farm. A community group challenged the approval, arguing that the farm would cause serious harm to human health, and serious and irreversible harm to plant life, animal life or the natural environment. The Environmental Review Tribunal upheld the approval. It ruled that the group failed to provide sufficient evidence to prove on a balance of probabilities that the project would cause the harm alleged [East Oxford Community Alliance Inc. v. Ontario (Environment and Climate Change), [2015] CanLII 68528 (ON ERT), Oct. 21, 2015].
