    I see a number of cases describing the distinction for handling marijuana in the work place between safety and non-safety sensitive positions. Do any AHJs provide a list of requirements or detailed description of what makes a job safety sensitive’ How can an organization be sure they are drawing the line properly to remain in compliance?

    Great Qs–and incredibly timely! The answer is NO and NO.

    Standard Definition: There are a lot of experts out there, including some of our OHSI advisors, calling on the federal govt. to adopt a standardized definition of safety-sensitive positions. But unless and until that happens–and it probably will–the standard definition is something in the order of a position requiring a high degree of care and safety and which becomes highly dangerous when done by a person who’s impaired.
    Official Lists: I’m aware of no Canadian jurisdiction that has compiled a list of safety-sensitive positions. But in the US, one agency has–Connecticut OSHA. The list is pretty comprehensive and I think you can rely on it. https://www.ctdol.state.ct.us/wgwkstnd/highrisk.htm
