Individual’s Personal Health Information Wasn’t Improperly Shared

An individual filed a complaint with the Office of the Information and Privacy Commissioner, claiming that personal health information collected during a medical assessment for the purpose of a fitness certificate for work as a firefighter/paramedic was improperly used and disclosed. The Commissioner dismissed his complaint. The individual had consented to the collection of the personal health information for a work-related medical assessment. A doctor and nurse properly used that information to determine whether he should be issued a fitness certificate. And his personal health information wasn’t shared outside ‘the circle of care,’ concluded the Commissioner [Morneau Shepell Ltd. (Re), [2017] CanLII 2262 (NL IPC), Jan. 23, 2017].
