Board Upholds Stop Work Order After Worker Dies in Scaffolding Fall
A worker was killed after falling from a scaffolding. OHS officers issued a stop work order and compliance order against the contractor that was erecting the scaffolding for not implementing a fall protection plan. The contractor appealed, arguing among other things, that the pulp mill where the fatality occurred didn’t count as a “worksite” requiring a fall protection plan under the OHS Code. The Alberta Labour Relations Board disagreed and upheld both orders [AlumaSafway, Inc. v. Alberta Occupational Health & Safety, Board File No. OHS2021-2, November 23, 2021].
