Arbitrator Upholds Mandatory COVID-19 Vaccination Policy

Courts and arbitrators are now weighing in on mandatory COVID-19 vaccination policies. One policy to survive an early legal challenge is the one covering 4,400 security guards working at 450 client establishments. Citing Ontario Human Rights Commission guidance and scientific information supporting the effectiveness of the vaccine, the arbitrator found policy valid and enforceable given the employer’s OHS law duty to ensure a safe workplace [United Food and Commercial Workers Union, Local 333 v. Paragon Protection Ltd., November 9, 2021].
