Information Posting Requirements

Here’s what you need to know about the information companies are required to post in the workplace under the OHS laws in your province:

FEDERAL: The Canada Labour Code requires employers to post a copy of the Code, a statement of the employer’s general health and safety policy and any other printed material related to health and safety that may be directed by a health and safety officer or that is prescribed (Sec. 125(1)(d)); the names, workplace phone numbers and work locations of all of the members of the JHSC or of the health and safety representative (Sec. 125(1)(z.17)). The Canada Occupational Health and Safety Regulations require employers to post the details of their evacuation plans and procedures (Sec. 17.6(2)); and information on the location and availability of first aid (Sec. 16.6(1)).

ALBERTA: The Occupational Health and Safety Regulations require employers to post an order made under the OHS Act that’s relevant to the worksite; a health and safety notice concerning conditions or procedures at the worksite (Sec. 9(1)); and a copy or record of an acceptance to a requirement under the OHS Act or regulations (Sec. 10(2)).

BRITISH COLUMBIA: The Workers’ Compensation Act requires employers to post a notice telling workers where a copy of the Act and the regulations are available for review (Sec. 115(2)(f)); the names and work locations of the JHSC members, the reports of the three most recent JHSC meetings and copies of any applicable orders for the preceding 12 months (Sec. 138); an occupational health and safety information summary from the workers’ comp board (Sec. 155(4)); an application for a variance under the Act (Sec. 167(1)(a)) and the workers’ comp board’s decision on the variance (Sec. 169(3)); a corrective action report following an incident investigation (Sec. 176(2)); an inspection report (Sec. 183); variation or cancellation of an order (Sec. 189); and a compliance report (Sec. 194). The Occupational Health and Safety Regulations require employers to post an inspection report (Sec. 2.5); notification of compliance (Sec. 2.6); any placard issued by the workers’ comp board entitled “Notice to Workers” (Sec. 2.7); and written first aid procedures (Sec. 3.17(2)).

MANITOBA: The Workplace Health and Safety Act requires employers to post compliance reports (Sec. 35(d)); the names of the JHSC members (Sec. 40(9)); and the name of the health and safety representative (Sec. 41(3)). The First Aid Regulation requires employers to post the locations at which first aid is available (Sec. 4); and a list of the names and locations of every first aider (Sec. 8(2)).

NEW BRUNSWICK: The Occupational Health and Safety Act requires employers to post the names of the JHSC members and the minutes of the most recent committee meeting (Sec. 14(9)); the name of the elected health and safety representative (Sec. 17(4)); a copy of the Act, the regulations and any notice which an officer considers advisable to enable employees to become acquainted with their rights, liabilities and duties under the Act and regulations (Sec. 44); and a code of practice (Sec. 50(4)). The First Aid Regulation requires employers to post the emergency communication procedure employees are to use to summon assistance in the event of an illness or accident (Sec. 5(2)(d)); the names of first aid providers (Sec. 7(2)); and the location of first aid kits (Sec. 13(2)).

NEWFOUNDLAND/LABRADOR: The Occupational Health and Safety Act requires employers to post a code of practice (Sec. 36(3)); a health and safety policy if the workplace has fewer than 10 workers (Sec. 36.2(2)); the names of the JHSC members (Sec. 38(7)); and the name of the worker health and safety representative (Sec. 43). The Occupational Health and Safety First Aid Regulations require employers to post a written notice outlining the policy and procedure for reporting injuries (Sec. 4(2)); a notice containing the name of the person in charge of the first aid kit or room, the name and qualifications of each person trained to administer first aid, and an emergency procedure and telephone list or other instructions for reaching the nearest police, ambulance, fire station, hospital or physician (Sec. 7); and the location of the first aid supplies and services (Sec. 11(2)). The Occupational Health and Safety Regulations require employers to post stop work orders (Sec. 19(1)); and the minutes of all regular and special committee meetings (Sec. 21(2)).

NORTHWEST TERRITORIES/NUNAVUT: The General Safety Regulations require employers to post signs showing the location of the first aid services and equipment and the necessity of reporting promptly injuries and of receiving first aid (Sec. 64); and a first aid attendant’s certificate of qualification (Sec. 75(2)).

NOVA SCOTIA: The Occupational Health and Safety Act requires employers to post the current names of the JHSC members or the health and safety representative, the means of contacting them and the minutes of the most recent committee meeting (Sec. 37); a current copy of the Act, a code of practice, a current phone number for reporting occupational health or safety concerns and, where one is required, an occupational health and safety policy (Sec. 38(b)); an order, compliance notice, notice of appeal or decision (Sec. 39(1)(d)); and an application for a deviation from the regulations (Sec. 83(4)) and a copy of the decision on such application (Sec. 83(10)(11)). The Occupational Health and Safety First Aid Regulations require employers to post the location of the first aid supplies and the location or phone number of the first aid attendant (Sec. 9(2)).

ONTARIO: The Occupational Health and Safety Act requires employers to post the names and work locations of the JHSC members (Sec. 9(32)); a summary of annual workers’ comp data (Sec. 12(2)); a copy of the Act and any explanatory material from the MOL outlining the rights, responsibilities and duties of workers (Sec. 25(2)(i)); the occupational health and safety policy (Sec. 25(2)(k)); an order (Sec. 57(10)(a)); and a notice of compliance with an order (Sec. 59(3)). Regulations under the Workplace Safety and Insurance Act require employers to post a poster called Form 82 on the necessity of reporting all accidents and receiving first aid (First Aid Requirements, Sec. 3); and information concerning the Workplace Safety and Insurance Act and the regulation (General Regulation, Sec. 19).

PRINCE EDWARD ISLAND: The Occupational Health and Safety Act requires employers to post the names of the current JHSC members or the health and safety representative and the means of contacting them, and the minutes of the most recent committee meeting (Sec. 27(7)); and a code of practice, a current phone number for reporting occupational health or safety concerns and, where required, an occupational health and safety policy (Sec. 27(8)(b)). The General Regulations require employers to post the location of first aid supplies and services (Sec. 9.3).

QUÉBEC: An Act respecting Occupational Health and Safety requires employers to post all information transmitted by the Commission, the agency and the physician in charge (Sec. 2(51)(10)); the names of the members of the JHSC (Sec. 80); and any remedial orders issued to the company (Sec. 183).

SASKATCHEWAN: The Occupational Health and Safety Act requires employers to post the names of the JHSC members or the health and safety representative (Sec. 17); and a written report on the progress made towards remedying a contravention of the Act or regulations (Sec. 35(a)(ii)). The Occupational Health and Safety Regulations require employers to post the fire safety plan (Sec. 360(1)(3)).

YUKON: The Occupational Health and Safety Act requires employers to post an order or inspection report (Sec. 41). The Minimum First Aid Regulations require employers to post the location of first aid supplies, equipment and services (Sec. 7(3)); and a placard titled “NOTICE TO WORKERS” stating the necessity of reporting promptly all injuries and of receiving first aid treatment (Sec. 9).
